Liability, Assumption Of Risk, Indemnity Agreement
In consideration of participating in activities at Elemental Arts Pole Dance & Fitness LLC, I represent that I understand the nature of this activity and that I am qualified, in good health, and in proper physical condition to participate in such activities. I understand that any health problems such as heart conditions, high blood pressure, pregnancy, any conditions where being upside-down or inverted is contra-indicated, and others not listed will not be allowed to participate in these activities without written approval by a doctor or physician.
I acknowledge that if I believe conditions to be unsafe, I will immediately discontinue participation in the activity. I acknowledge that I am voluntarily participating in this activity. I am fully aware that aerial arts, including but not limited to aerial silks, lyra, pole skills, pole dance, chair acrobatics, chair dance, and related activities, contains dangers and inherent risks (including serious injury and death), that no amount of care, caution, instruction or expertise can eliminate. I understand the scope, nature, and extent of the risks involved and I voluntarily and freely choose to assume any and all such risks. I fully understand that this activity involves risk of serious bodily injury, including permanent disability, paralysis and death, which may be cause by my own actions or inactions, those of others participating in the activity, the conditions in which the activity takes place, or the negligence or the participant signed below; and that there may be other risks either not known to me or readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the activity.
I hereby release, discharge, and covenant not to sue or take legal action against Elemental Arts Pole Dance & Fitness LLC, its respective administrators, owners, directors, agents, officers, volunteers, employees, other participants, any sponsors or advertisers, and, if applicable, owners and lessors of premises on which the activity takes place (each considered one of the Releasees herein) from all liability, claims, demands, losses, or damages on account, caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk, I, or anyone on my behalf, makes a claim against of the the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage or cost, which may incur as a result of such claim.
Parents and/or guardians are solely responsible for getting their minor to and from the facility safely and holds Elemental Arts Pole Dance and Fitness LLC harmless of any events that may occur coming to/in or leaving from the facility. Further, I hereby accept full responsibility and assume any and all risk for the safety and integrity of personal apparatuses or equipment, should you choose to bring and/or use them at Elemental Arts Pole Dance & Fitness LLC. I, the minor’s parent and/or legal guardian, understand the nature of the above referenced activities and the minor’s experience and capabilities and believe the minor to be qualified to participate in such activity. I release, discharge, and covenant not to sue and agree to indemnify and hold harmless all Releasees from all liability, claims, demands, losses or damages the minors account cause or alleged to have caused in whole or in part as stated in the above agreement.
I hereby grant Elemental Arts Pole Dance & Fitness LLC permission to interview me and/or use my likeness in photograph(s)/video in any or all of its publications and in any or all other media, whether now known or existing hereafter, controlled by Elemental Arts Pole Dance & Fitness LLC in perpetuity, and for all other use by Elemental Arts Pole Dance & Fitness LLC. I will make no monetary or other claim against Elemental Arts Pole Dance & Fitness for the use of the interview and or photograph(s)/video.
I understand and will comply with Elemental Arts Pole Dance & Fitness LLC policy that recreational drug and/or alcohol use or consumption is prohibited during class time and on studio property.
I have read the Release of Waiver and Liability, Assumption of Risk and Indemnity Agreement, and understand that I have given up substantial rights by signing it. I have signed it freely and without inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect. I acknowledge that I have been advised to obtain legal advice concerning the ramifications of signing this document.
